co PI <br /> INTERGOVERNMENTAL AGREEMENT <br /> THIS INTERGOVERNMENTAL AGREEMENT ("Agreement") is entered into this <br /> rf day of J I,( , 2026, by and between the Sanitary District of Decatur, an <br /> Illinois unit of local government(the"District"), and the City of Decatur, a municipal corporation <br /> (the "City"). <br /> WHEREAS, the City wishes to construct a pump station on Brush College Road and an <br /> accompanying force main from the Brush College pump station to the District's northside <br /> interceptor located on North Woodford Street; <br /> WHEREAS, as of the date of this Agreement, the northside interceptor has the reserve <br /> capacity to convey the estimated 5 million gallons per day of waste water proposed in planning <br /> the Brush College pump station; <br /> WHEREAS, as of the date of this Agreement, the District maintains a 14-inch force main <br /> from the Damon Avenue pump station to the northside interceptor; and <br /> WHEREAS, the 14-inch force main must be upsized to accommodate the Brush College <br /> pump station flow. <br /> NOW,THEREFORE, in consideration of the mutual covenants contained herein and other <br /> good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged <br /> by the parties hereto,the parties agree as follows: <br /> 1. The City will, at its sole cost and expense, complete all work and obtain all labor and <br /> materials to construct the pump station on Brush College Road, to construct the force main from <br /> the Brush College pump station to the District's northside interceptor, and to upsize the existing <br /> 14-inch force main from the Damon Avenue pump station to the northside interceptor <br /> (collectively, such work shall be defined herein as the"Project"). <br /> 2. The City will, at its sole cost and expense, obtain all necessary easements, permits, and <br /> other approvals necessary to complete the Project.The District hereby grants the City and its agents <br /> and contractors a limited license to use the easements of the District included herewith as Exhibit <br /> A to complete the work necessary to upsize the existing 14-inch force main from the Damon <br /> Avenue pump station to the northside interceptor and for no other purpose. When using easements <br /> of the District, the City shall comply with all requirements of the "Grantee" set forth in the <br /> easements and shall perform all the responsibilities of the"Grantee"under those easements. <br />
