LEGAL REVIEW: The form of agreement form was approved as a template by the Legal Department on
September 21, 2022.
PRIOR COUNCIL ACTION:
September 25,2023—Study session in which the Mayor and City Council received a briefing on the watershed
protection program.
January 11, 2024—Council reaffirmed Priority Goal#6, Collaborate with others in ensuring integrated and
wholistic management of city-owned open spaces, transportation corridors, and especially Lake Decatur. Key
Implementation Strategy#2 for this goal was also reaffirmed: Implement recommendations of a Lake
Management Plan so that the quantity of sediment, silt and nitrates entering Lake Decatur is significantly
reduced, and adopt other strategies designed to assure good water quality and watershed protection.
POTENTIAL OBJECTIONS: There are no known objections to this resolution.
INPUT FROM OTHER SOURCES:
The project was designed by City staff.
STAFF REFERENCE: Matt Newell, Public Works Director, Robert Weil, Water Production Manager,
Jennifer Gunter, Watershed and Lake Manager. Matt Newell will attend the City Council meeting to answer any
questions of the Council on this item.
This memorandum was written by Jennifer Gunter, Water Resource and Lake Manager.
BUDGET/TIME IMPLICATIONS: Budget Impact: These projects are funded by the Water Lake Capital
Budget-Watershed Management. In order to successfully incentivize landowners to construct these watershed
conservation projects, landowners are reimbursed by the City for 90%of the total project cost. Landowners pay
for the remaining 10% of the cost.
The popularity of the program at the 90%cost sharing rate has prompted staff to reduce the cost sharing rate in
future years. These revised cost sharing rates are currently under development.
The agreement financials are:
Owner Cost$ 3,810.00
Maximum City Cost(reimbursed to owner after construction) $34,290.00
Total Not to Exceed Project Cost$38,100.00
These water utility expenditures have significant return on investment. Each project contributes to the larger
goal of protecting Lake Decatur from siltation and deferring future dredging expenses and impacts. Also, these
city-funded projects serve to attract significant grant funding from the state and federal governments.
Furthermore, the program continues to build credibility and momentum within the local agricultural community
for adoption of conservation efforts.
Staff Impact: Staff has allocated time to manage this project.
ATTACHMENTS:
1. 2026-59 Resolution Fulk Family Farm, LLC Watershed Protection Agreement
2. 2026-59 Location Map.
