a
Excerpts from Plan Commission Meeting on September 4,2025:
Case No. 25-09 Petition of NICHOLAS MILLER to rezone the property located at 271
SOUTH 26th STREET AND 601 S. 27TH STREET from R-3 Single
Family Residence District and M-2 Heavy Industrial District to PD
Planned Development.
It was moved and seconded (Jim Schwarz/Maurice Payne) to forward Case No. 25-09 to the
City Council with a recommendation of approval as set forth in the staff report.
Joselyn Stewart discussed staffs recommendation for approval of the petition based on the staff
report distributed to the Plan Commission prior to the meeting (staff report is on file and is
available for reviewing by request).
Stephanie Brown of Chastain, on behalf of the Petitioner, was sworn in by Amy Goodman and
stated that the Park District is negotiating a contract for a lease agreement.
Nick Miller, Skye's the Limit, was sworn in by Amy Goodman and stated that he was waiting
for
approval of a fence before signing the lease and that it should take place in the next week or two.
Discussion: A.G. Webber stated he is not opposed but would like for the Park District to have a
signed agreement. Greg noted the vote could stipulate "prior to Lease being signed" and stated
guidelines are if not developed after two years it becomes null. It was decided that the lease
should be signed prior to Council approval.
Upon call of the roll, Commission members A.G. Webber, Matt Naber, Bobby Garner, Maurice
Payne, Andrew Taylor, James Schwarz, James Oliver, Susie Peck voted aye. Motion carried.
