2.Tenant shall perform all sales described in is paragraph in accordance with <br /> federal, state, and local laws,ordinances,rules, and gulations. Tenant shall be solely <br /> responsible for obtaining the necessary permits, lice ses, certifications, or permissions from <br /> applicable authorities to perform the sales described in this paragraph. Said authorities may <br /> include but are not limited to the City of Decatur, M:con County, and the Illinois <br /> Environmental Protection Agency. <br /> 3.Any rezoning of the property and any expen V s required for the intended use shall be <br /> the responsibility of the Tenant <br /> 4. The District shall approve the material used i the Decorative Screening Fence and <br /> buffer landscaping vegetation prior to its installation. -nant agrees to maintain the fencing in <br /> good condition, including performing periodic mainte :nce such as replacing any damaged <br /> panels and regular painting. Tenant agrees to regularly maintain the buffer landscaping <br /> including but not limited to trimming,pruning, weedin watering as required, and replacing <br /> diseased plants as necessary to maintain the landscape 'uffer standards as outlined in Exhibit <br /> EX001 and any other landscaping plan approved and ,'uired by the City of Decatur. <br /> 5. The District shall have the right to inspect th- premises on regular basis to ensure <br /> compliance with the above conditions. <br /> 6. The District shall have access to the premises in case of emergency. <br /> 7. Either party may terminate this lease upon the occurrence of a material breach by the <br /> other party,provided written notice of such breach is gi en and the breaching party fails to cure <br /> such breach within 30 days after receipt of notice (or if.uch breach cannot be reasonably be <br /> cured within 30 days, fails to commence cure within 30 days and diligently purse cure to <br /> completion within 90 days). <br /> 8. Tenant understands and acknowledge that I e District was created for the purpose <br /> of establishing, maintaining and governing all its par s and facilities for the use, recreation, <br /> health and benefit of the general public. This agreem-nt is entered into subject to the <br /> direction and limitation of this principle. Therefore, enant and District specifically agree <br /> that this Agreement is subject to cancellation by the istrict at any time if the District <br /> determines that the business operation by Tenant on th Premises is contrary to,or inconsistent <br /> with, the aforesaid purposes,or if this use shall become" violation of a federal, state or local <br /> law,regulation or ordinance. If the District makes the d, ermination to cancel this Agreement <br /> under this provision, it shall first give Tenant one hund .I twenty(120)days' written notice to of <br /> the specific violation and an opportunity to remedy the iolation within the notice period. <br /> 9. Tenant agrees that nothing will be stored on e Leased Premises that would constitute <br /> an environmental hazard. <br /> 10. No alcohol or cannabis shall be consumed o the leased premises <br /> 11. No fires shall be lit on the leased premises. <br />
