1. Existing Uses and Zoning of Nearby Property
The subject parcel at 357 W Decatur St is surrounded by a mix of R-3 and R-6 zoning
designations, including several places of worship and private clubs, which share similar
operational characteristics with the proposed uses of the subject parcel. The property is
currently zoned R-6. Proposed use aligns with the character and intent of the surrounding
neighborhood.
2. Impact of Existing Zoning on Property Values
Granting a Conditional Use Permit would encourage continued investment in the surrounding
neighborhood through the restoration of a prominent historic property, which is currently
deteriorated and now-vacant.
3. Promotion of Public Health, Safety, Morals, and General Welfare
The restoration of this now-vacant parcel into a wedding venue advances public welfare goals.
The parcel is fully served by municipal utilities and infrastructure, supporting safe and orderly
development. The proposed use has been designed to minimize impacts on neighboring
properties. Noise will be managed through strict volume limits, event curfews, and the use of
sound dampening materials through the restoration. Parking will be accommodated through
nearby public and private lots and shuttle or valet services, with policies prohibiting guest
parking on surrounding residential streets. Because of these operational safeguards, the
proposed use will not adversely affect the public health, safety, or welfare of the surrounding
community.
4. Relative Gain to the Public as Compared to Hardship to the Owner
Withholding the Conditional Use Permit would prohibit the conditional sale of this property and
prevent productive restoration of an important historic property. The public gains significantly
through new investment and utilization of a previously blighted, now-vacant property. The
hardship to the owner under current zoning outweighs any negligible burden on the public.
5. Suitability of the Property for Proposed vs. Current Zoning
The sites 1,300sq ft ballroom and sizable yard make it more reasonably suitable for a wedding
venue and residence than solely a private residence, as the costs associated with restoring and
maintaining a property of this magnitude would otherwise prohibit all but the wealthiest of
buyers. The requested use will provide financial sustainability necessary to restore and preserve
this historic property while maintaining its residential character. The proposed Conditional Use
Permit fully conforms to the intended Historic Neighborhood Uses and regulations as set forth in
the Decatur city zoning ordinance.
6. Length of Time the Property Has Remained Vacant Under Current Zoning
The parcel is currently vacant land, having been vacant since 2023, and also suffered long
bouts of vacancy in the 1930's, 1960's, and 1970's. Granting of the proposed Conditional Use
Permit could prevent future bouts of vacancy through providing the property opportunity for
financial sustainability.
7. Care with which the community has planned land use development
This Conditional use permit aligns with Decatur's planning process, and will strictly adhere to
any and all applicable building codes while maintaining the historical integrity and character of
the building. No exterior changes are proposed other than historically appropriate restoration
intended to return the mansion to as close as possible to its original appearance based on
available historical documentation.
