EMPLOYMENT OPPORTUNITY 'EXHIBIT A"', are hereby incorporated into, and <br /> made a part of this AGREEMENT as if fully set forth herein. <br /> 2. As a condition of the City making payments under this Agreement, FS <br /> shall comply with the "SPECIAL PROVISIONS", including but not limited to <br /> providing City copies of all required EPA and IEPA permits <br /> 3. The term of this Agreement shall be as described in Section 1.04 of the <br /> SPECIAL CONDITIONS hereto. <br /> 4. Assignment. No assignment by a party hereto of any rights under or <br /> interests in the contract will be binding on the other party to this contract without <br /> the written consent of the party sought to be bound. <br /> 5. Amendment. Neither this Agreement, nor any document incorporated <br /> herein may be amended without the mutual consent of the Parties evidenced by <br /> a written amendment. <br /> 6. Limited Liability of City to Others for FS' Expenses. There shall be no <br /> obligation by the City to make any payments to any person other than FS, nor <br /> shall the City be obligated to make direct payments to any contractor, <br /> subcontractor, mechanic or materialman providing services equipment to FS for <br /> the work contemplated by this Agreement. <br /> 7. Waiver. Any party to this Agreement may elect to waive any remedy it <br /> may enjoy hereunder, provided that no such waiver shall be deemed to exist <br /> unless the party waiving such right or remedy does so in writing. No such waiver <br /> shall obligate such party to waive any right or remedy hereunder, or shall be <br /> 2 <br />
