N ��. <br /> FAP 710 IL 105 <br /> Section: (48X-B-2) BR & (48BR) BR <br /> CITY Section 14-00422-00-BR <br /> Macon County <br /> Contract No.: 74438 <br /> Agreement: JN 714 006 <br /> Job Number: C-97-041-10 <br /> AGREEMENT <br /> This agreement entered into this /% day of 45U5tAD, 2014, by and between the <br /> STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION <br /> hereinafter called the STATE, and the CITY OF DECATUR in Macon County of the State of <br /> Illinois, hereinafter called the CITY. <br /> WITNESSETH: <br /> WHEREAS, the STATE in order to facilitate the free flow of traffic and insure safety to <br /> the motoring public, is desirous of improving BUS US 51 (FAP Route 710, Section (48X-B-2) BR <br /> & (48BR) BR, CITY Section 14-00422-00-BR) at structures (NB #058-0010 and SB #058-0049 ) <br /> carrying BUS US 51 over Lake Decatur at the south edge of the CITY by replacing the bridge <br /> decks on both bridges and replacing the back wall and bearings on the southbound bridge, <br /> installing new light poles and luminaires, installing a drainage system, pavement makings and <br /> guardrail and any other work required to complete this section. Right of way will not be <br /> required. A temporary crossover will be used to divert traffic during the construction. <br /> WHEREAS, the CITY is desirous of said improvement in that same will be of immediate <br /> benefit to the CITY residents and permanent in nature; and <br /> WHEREAS, the City, being desirous of protecting the city water supply, requested a <br /> closed drainage system be installed on the bridges and a closed storm sewer, directing the flow <br /> away from the Lake <br /> NOW, THEREFORE, in consideration of the mutual covenants contained herein, the <br /> parties hereto agree as follows: <br /> 1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare <br /> plans and specifications, receive bids and award the contract, furnish engineering <br /> inspection during construction and cause the improvement to be built in accordance with <br /> the plans, specifications and contract. <br /> 2. The STATE agrees to pay for all construction and engineering costs, subject to <br /> reimbursement by the CITY as hereinafter stipulated. <br /> 3. It is mutually agreed by and between the parties hereto that the estimated cost and cost <br /> proration for this improvement is as follows: <br />
