FAP 710 IL 105 Section: (48X-B-2) BR & (48BR) BR CITY Section 14-00422-00-BR Macon County Contract No.: 74438 Agreement: JN 714 006 Job Number: C-97-041-10 AGREEMENT This agreement entered into this /% day of 45U5tAD, 2014, by and between the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION hereinafter called the STATE, and the CITY OF DECATUR in Macon County of the State of Illinois, hereinafter called the CITY. WITNESSETH: WHEREAS, the STATE in order to facilitate the free flow of traffic and insure safety to the motoring public, is desirous of improving BUS US 51 (FAP Route 710, Section (48X-B-2) BR & (48BR) BR, CITY Section 14-00422-00-BR) at structures (NB #058-0010 and SB #058-0049 ) carrying BUS US 51 over Lake Decatur at the south edge of the CITY by replacing the bridge decks on both bridges and replacing the back wall and bearings on the southbound bridge, installing new light poles and luminaires, installing a drainage system, pavement makings and guardrail and any other work required to complete this section. Right of way will not be required. A temporary crossover will be used to divert traffic during the construction. WHEREAS, the CITY is desirous of said improvement in that same will be of immediate benefit to the CITY residents and permanent in nature; and WHEREAS, the City, being desirous of protecting the city water supply, requested a closed drainage system be installed on the bridges and a closed storm sewer, directing the flow away from the Lake NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with the plans, specifications and contract. 2. The STATE agrees to pay for all construction and engineering costs, subject to reimbursement by the CITY as hereinafter stipulated. 3. It is mutually agreed by and between the parties hereto that the estimated cost and cost proration for this improvement is as follows:
