' BID PROPOSAL <br /> In submitting this Proposal, it is understood that the right is reserved by the Owner to <br /> reject any or all Proposals and waive informalities or irregularities in Proposals. The Owner also <br /> reserves the right to delay the award of a contract for a period not to exceed 45 days from the <br /> date of the opening. <br /> The undersigned further agrees, if awarded the Contract for the work included in this <br /> Proposal, to begin and to complete and deliver the work contemplated in accordance with all the <br /> conditions set forth in the Contract Documents. <br /> The undersigned has carefully checked the figures inserted by them and understands that <br /> they are the Bidder's sole responsibility, and the Owner will not be responsible for any errors or <br /> omissions on the part of the undersigned Bidder in preparing this Proposal. <br /> The undersigned certifies that this Proposal is genuine, not collusive, or made in the <br /> interest or behalf of any person not named as provided in the Instruction to Bidders, and that the <br /> undersigned has not, directly,or indirectly, induced or solicited any other Bidder, or induced any <br /> other person, firm, or corporation to refrain from submitting a proposal, and the undersigned has <br /> not in any manner sought by collusion to secure for themselves an advantage over any other <br /> Bidder. <br /> Attached, as a proposal guaranty, is a properly certified check made payable to <br /> "Treasurer, City of Decatur", Decatur, Illinois, in an amount not less than ten (10) percent of the <br /> bid; or a cashier's check made payable to "Treasurer, City of Decatur", Decatur, Illinois, in an <br /> amount not less than ten(10)percent of the bid;or a bid bond on a form approved by the City of <br /> Decatur, executed by a surety company satisfactory to the City in an amount not less than ten <br /> (10)percent of the bid. <br /> It is expressly understood that the proposal guaranty is given as a guarantee that the <br /> bidder will execute the contract and furnish acceptable bonds and required insurance, if awarded <br /> the work, and the amount thereof represents the agreed damages that the Owner will sustain if <br /> the bidder fails or refuses within ten (10) days from and including the date of the Notice of <br /> Award of the Contract, to execute and deliver said Contract and deliver the required bonds and <br /> insurance shall be just cause for the cancellation of the award and the forfeiture of the proposal <br /> guaranty which shall become the property of the City, not as penalty, but in liquidation of <br /> damages done. Award may be then made to the next lowest qualified bidder, or the work re- <br /> advertised and constructed under contract,or otherwise, as the City may decide. <br /> The Bidder grants the Owner the right to hold the lowest three (3) Proposals received, <br /> together with the accompanying bid securities, for a period of 45 days after the date of opening <br /> of said Proposals. <br /> 10 <br />
