' . r <br /> 1 <br /> DNR Grant/Project No.:M2PO4-11 <br /> O m A MUD TO PARKS GRANT AGREEMENT <br /> G) ('' between the <br /> m STATE OF ILLINOIS,DEPARTMENT OF NATURAL RESOURCES' <br /> z N e CONSERVATION 2000--ECOSYSTEMS PROGRAM <br /> o N C and <br /> M THE CITY OF DECATUR <br /> z � <br /> y <br /> This agreement is made and entered into this 4th day of April , 2012 ,by and between <br /> the Department of Natural Resources(Department or Grantor)and the City of Decatur(Grantee). <br /> The Department has the authority,pursuant to the Department of Natural Resources Act,20 <br /> ILCS 801/,the Civil Administrative Code of Illinois (Department of Natural Resources. <br /> (Conservation)Law), 20 ILCS 805/,the Illinois Finance Act 30 ILCS 105/and administrative <br /> rules, 17111.Adm. Code 1523 "Conservation 2000—Ecosystems Program', to enter into this <br /> Grant Agreement(Agreement)for the following purposes: <br /> 1. To find beneficial uses for the sediment that is clogging Illinois' rivers and lakes. <br /> 2. To find innovative projects that reuses the sediment as topsoil. <br /> 3. To ensure both benefit to the public and to habitat. <br /> In view of mutual covenants herewith contained,the Department and Grantee agree as follows: <br /> ARTICLE 1:PROGRAM TERMS AND CONDITIONS GOVERNING GRANT <br /> I. GRANT PROJECT AND AMOUNT:The Department agrees to provide a grant in the <br /> maximum amount of$245,770 to the Grantee subject to the terms and conditions of this <br /> Agreement for the following project: <br /> Project Title: Corley Landfill Conversion to Native Prairie Grass Bioenergy Site <br /> Project Description: Approximately 13,310 cubic yards of Lake Decatur dredge <br /> sediment will be trucked from the City of Decatur's settling basin to a City owned <br /> landfill.Sediment will be spread to a 9"+/-thickness to supplement the landfill's 6" <br /> topsoil cover so that approximately 11 acres of native prairie grass and forbs can be <br /> established for bioenergy crop production. <br /> 2. TERM: This Agreement is effective this 4th day of April , 2012 ,upon date of <br /> execution and shall terminate on December 31,2014 . The Grantee shall use its best <br /> efforts and due diligence to complete the project within the grant term. <br /> Any request for an extension to this Agreement must be delivered to the Division of Grant <br /> Administration at the address identified in Paragraph 10 herein.
