Anderson Plaza `-4-b J
Decatur, IL 62523
Honorable Members of City Council:
CITY CLERK
First of all let me thank you for the opportunity to have been of service to the City of Decatur for
the last 11 years as your transit management company. We value our relationship with the City
of Decatur and were disappointed to learn of the decision to award MV for the new management
contract, since we believe that our past performance and capabilities going forward bring the
best value to the City.
I write to you today to advise you that First Transit believes that your procurement for Transit
Management Services was flawed and we wish to formally protest the decision to award the
contract to MV.
We base this protest on several factors:
1. The City considered a proposal from MV that was "conditional' and thereby non-
responsive with the RFP that governed this procurement First Transit offers the
followina facts to support our position:
• Section 9.0, Preparation of Proposal(s), clearly states, "Conditional proposals, or
those that have taken exception to the specifications, will be considered non-
responsive and will be rejected."
• Section 12.0, Qualifications For Award, states, "Contract award shall be made
only to a proposer found to be both responsive and responsible."
• The MV candidate for GM was disclosed by the City at the opening of the
Proposals to be Jerome Parker.
• During the in-person interview process conducted by the Denton County Transit
Authority(DCTA)on April 8, 2014 held in Lewisville, Texas, representatives of
First Transit met Mr. Jerome Parker, who along with representatives of MV, were
preparing for an interview with the DCTA for a procurement for Transit
A FustCroulp America Op'Company
