The Consulting Engineer-expressly acknowledges, recognizes and agrees that the only authority to <br /> approve change orders to this Agreement or the Scope or Services or the cost(s) therein is with the <br /> City Council of the City. <br /> SECTION II. BASIC SERVICES <br /> A. CONSTRUCTION PHASE. <br /> The Consulting Engineer shall, after written authorization to proceed with the Construction Phase: <br /> 1. General Duties. The Consulting Engineer shall consult with and advise the City's Representative <br /> and act as its representative as provided herein and in the General Conditions of the construction <br /> contract for the Project. The primary responsibility of the Consulting Engineer in this phase of <br /> the work shall be to answer requests for information from the City's Representative and to <br /> provide information and guidance to the City's Representative relating to undiscovered <br /> conditions and/or changes to the plans deemed necessary by the City during construction. <br /> 2. Review of Technical and Procedural Aspects. When directed by the City Representative, the <br /> Consulting Engineer shall review and approve (or take other appropriate action) with respect to <br /> Shop Drawings, the results of tests and inspections and other data which each Contractor is <br /> required to submit, determine the acceptability of substitute materials and equipment proposed by <br /> the Contractor(s), and review (for general content as required by the Specifications) maintenance <br /> and operating instructions, schedules, guarantees, bonds and certificates of inspection which are <br /> to be assembled by the Contractor(s). <br /> I Conferences and Meetings. When invited by the City Representative, the Consulting Engineer <br /> shall attend meetings with the Contractor, such as pre-construction conferences,progress <br /> meetings,job conferences, and other project-related meetings, and prepare and circulate copies of <br /> the minutes thereof to the City's Representative. <br /> 4. Reports. When directed by the City's Representative, the Consulting Engineer shall, <br /> a. Consult with the City's Representative, in advance of scheduled major tests, inspections,or <br /> start of important phases of the Work. <br /> b. Make recommendations to the City's Representative regarding Change Orders and Field <br /> Orders. <br /> 5. Contract Interpretation; Review of Quality of Work. When directed by the City's Representative, <br /> the Consulting Engineer shall: <br /> a. Issue necessary interpretations and clarifications of the Contract Documents and in <br /> connection therewith prepare change orders as required, subject to the City's Representative's <br /> approval. <br /> 6. Determination of Substantial Completion. When directed by the City's Representative, the <br /> Consulting Engineer shall assist with an inspection to determine if the Project is substantially <br /> complete and conduct a final inspection to determine if the work has been completed in the intent <br /> of the Contract Documents and if each Contractor appears to have fulfilled all of his obligations <br /> there under. <br /> 7. Authority and Responsibility. The Consulting Engineer shall not guarantee the work of any <br /> Contractor or Subcontractor, shall have no authority to stop work, shall have no supervision or <br /> control as to the work or persons doing the work, shall not have charge of the work, shall not be <br /> Last Revised:05/15/2013 <br />
