ORDINANCE NO. 2014-72 <br /> ORDINANCE AMENDING ZONING ORDINANCE <br /> - SECTION II. DEFINITIONS - <br /> WHEREAS, on the 4th day of December, 2014 upon due notice, the Decatur <br /> City Plan Commission held a public hearing on the petition of Billy Typs, Assistant City <br /> Manager,to modify and amend the Zoning Ordinance of the City of Decatur, the same <br /> being Ordinance No. 3512, as amended, by amending Section Il. DEFINITIONS thereof <br /> at the definitions of Boarding or Lodging House and Family thereof, so that said Section II <br /> as modified and amended shall provide as set forth below and shall provide as set forth in <br /> Exhibit A attached hereto and hereby made a part hereof. <br /> SECTION II. DEFINITIONS <br /> BOARDING OR LODGING HOUSE: A building other than a hotel <br /> where, for individual compensation and by arrangement for rooms <br /> designed for sleeping, lodging or lodging and meals are provided for <br /> three (3) or more persons. This includes multi-room structures where <br /> individuals pay for a bedroom and common living areas. <br /> FAMILY: Either: (a) Two or more persons, all of whom are related to <br /> each other by blood, marriage, or adoption, together with usual <br /> domestic servants and not more than one boarder or lodger, all living <br /> together as a single housekeeping unit and using common kitchen <br /> facilities; or(b) Eight or fewer persons, any or all of whom are not <br /> related to each of the others by blood, marriage, or adoption, all living <br /> together as a single housekeeping unit and using common kitchen <br /> facilities. For purposes of this Zoning Ordinance, however, an <br /> unrelated family shall not include persons living together in a <br /> Residential Care facility, Intermediate or Long Term Care facility, <br /> Foster Home, Congregate Elderly Housing; or in a boarding or lodging <br /> house, club, convent, dormitory, fraternity, monastery, or sorority. <br /> WHEREAS, the Decatur City Plan Commission did report its Findings and did <br /> recommend that said petition be granted and that the Zoning Ordinance be so modified <br /> and amended. <br />
