ADDITIONS AND <br /> CHAPTER 34 - TRAFFIC <br /> CHAPTER 34, SECTION 37(J) <br /> 37. REMOVAL OF VEHICLES. Police officers are hereby authorized <br /> to remove or cause to be removed a vehicle from a public street or highway to <br /> the nearest garage, impound lot or other place of safety, or to a location <br /> designated by the Police Chief, under the following circumstances: <br /> J. When a sound amplification system in any vehicle has been used in <br /> violation of Section 10 of Chapter 73 of the City Code and the vehicle owner <br /> has received a prior written warning for a violation of this Section. No vehicle <br /> shall be impounded unless the owner received a prior written warning for <br /> operating a vehicle in violation of Section 10 of Chapter 73 or for owning any <br /> vehicle used in violation of the provisions of this Section. <br /> CHAPTER 34, SECTION 38(B) <br /> B. The provisions of this subsection shall be applicable to vehicles <br /> removed pursuant to Sections 37 (J) (K) (L) and Se^ ' through 37 <br /> PX) (V) inclusive of this Chapter: <br /> CHAPTER 73 — OFFENSES <br /> CHAPTER 73, SECTION 10. NOISE ON PUBLIC STREET <br /> A. No driver of any motor vehicle within the City of Decatur shall operate <br /> or permit operation of any sound amplification system which can be heard <br /> outside the vehicle from seventy five (75) or more feet when the vehicle is <br /> being operated upon a street, highway or roadway unless such system is <br /> being operated to request assistance or warn of a hazardous situation. This <br /> section does not apply to authorized emergency vehicles. (Amended, <br /> Ordinance No. 2003-56, September 15, 2003) <br /> B. A written warning shall be issued prior to any penalties being <br /> assessed under this Section. No penalties shall be asses ed unless the <br /> violator was issued a prior written warning for operating a vehicle in violation <br /> of the provisions of this Section or for owning any vehicle used in violation of <br /> the provisions of this Section. <br />
