LEGAL DEPARTMENT MEMORANDUM <br /> NO. 2014-11 <br /> November 12, 2014 <br /> TO: Honorable Mayor McElroy and City Counsel <br /> FROM: Ryan McCrady, City Manager <br /> Wendy Morthland, Corporation Counsel <br /> James Chervinko, Interim Chief of Police <br /> RE: Noise Ordinance <br /> In an effort to provide some notice and warning of a noise ordinance in the <br /> City of Decatur, the City Council has asked that the City Code be amended. After <br /> several presentations from citizens and study sessions, Council indicated it <br /> wished to amend the City Code to provide a warning to those alleged to be in <br /> violation prior to penalties being assessed, including towing of vehicles used in <br /> violation of the ordinance. Under these proposed changes, the owner and <br /> operator of the vehicle each are issued a written warning for the first offense. <br /> The driver is fined $250 for any subsequent violation if the driver first was <br /> given a written warning as driver or owner of any vehicle in violation of the noise <br /> ordinance. <br /> The vehicle is towed for subsequent violations if the owner first was given <br /> a written warning as driver or owner of any vehicle in violation of the noise <br /> ordinance. <br />
