DEVELOPMENT SERVICES MEMORANDUM
No. 14-28
September 29, 2014
TO: Honorable Mayor Michael T. McElroy and City Council
FROM: Ryan P. McCrady, City Manager
Billy Tyus,Assistant City Manager
Suzan M. Stickle, Senior Planner
SUBJECT: Rezone 799 South 22"d Street to B-2
SUMMARY RECOMMENDATION: Staff recommends approval of the rezoning to B-2
Commercial District. The City Plan Commission voted 7-0 to recommend approval of this
petition at the September 4, 2014 meeting; the minutes of the meeting are attached.
BACKGROUND: The subject site is approximately .42 acres and is located at 799 South 22"d
Street. It is developed with a restaurant and parking lot that serves the business.
The petitioner proposes to rezone from R-3 Single Family Residene District and B-1
Neighborhood Shopping District to B-2 Commercial District to allow for all permitted uses in
the B-2 Commercial District that would also be able to meet all other zon* ordinance and site
development requirements. The rezoning will also consolidate the property that is currently
encompassed by multiple zoning districts (B-1, Neighborhood Shopping District and R-3 Single
Family Residence District) into one (1) district(B-2 Commercial District).
The surrounding zoning includes B-2 Commercial District to the soutk R-3 Single Family
Residence District to the north and east and B-1 Neighborhood Shoppin District to the west.
The permitted land uses in the B-2 Commercial District are compatible wi$ adjacent uses to the
south and east.
The Macon County and Decatur Comprehensive Plan shows this area as retail. This property is
adjacent to South 22"d Street which is a state route and a major thoroughf e m the City and not
conducive to residential development. A commercial use fronting a state cute is an appropriate
use for this property.
POTENTIAL OBJECTION: There were no known objectors at e Plan Commission
Meeting.
INPUT FROM OTHER SOURCES: The petition has been reviewed b the City's Technical
Review Committee; Planning, Engineering and Fire.
STAFF REFERENCE: Any additional questions may be forwarded to Su@ M. Stickle at 424-
2786 or at smstickle@decaturil.gov.
BUDGET/TIME IMPLICATIONS: None.
