I <br /> Excerpts from Plan Commission Minutes of September 4,2014: <br /> Cal.No. 14-26 Petition of ROGER K. JOHNSON,to rezone <br /> property located at 799 SOUTH 22nd STREET <br /> from R-3 Single Family Residence District and B-1 <br /> Neighborhood Shopping District to B-2 <br /> Commercial District. <br /> Ms. Suzy Stickle was sworn in by Mrs. Janet Poland. <br /> Ms. Stickle presented the recommendation of staff. <br /> The subject site is approximately .42 acres and is located at 799 South 22"d Street. It is <br /> developed with a restaurant and parking lot that serves the business. <br /> The petitioner proposes to rezone from R-3 Single Family Residence District and B-1 <br /> Neighborhood Shopping District to B-2 Commercial District to allow for all permitted uses in <br /> f the B-2 Commercial District that would also be able to meet all other zonin ordinance and site <br /> development requirements. The rezoning will also consolidate the property that is currently <br /> encompassed by multiple zoning districts (B-1, Neighborhood Shopping District and R-3 Single <br /> Family Residence District) into one(1) district(B-2 Commercial District). <br /> The surrounding zoning includes B-2 Commercial District to the south, R-3 Single Family <br /> Residence District to the north and east and B-1 Neighborhood Shopping Pistrict to the west. <br /> The permitted land uses in the B-2 Commercial District are compatible with(adjacent uses to the <br /> south and east. <br /> The Macon County and Decatur Comprehensive Plan shows this area as retail. This property is <br /> adjacent to South 22"d Street which is a state route and a major thoroughfare in the City and not <br /> conducive to residential development. A commercial use fronting a state route is an appropriate <br /> i use for this property. <br /> Staff recommends approval of the rezoning. <br /> 4 A motion to forward Calendar Number 14-26 to the City Council with a recommendation for <br /> approval is suggested. <br /> Mr. Steve Baumann,representative,was sworn in by Mrs. Poland. <br /> Mr. Baumann stated the petition was brought before the Plan Commission �or reasons that Ms. <br /> Stickle previously stated. <br /> Chairman Glenn Livingston asked what the rezoning would allow them to do that they cannot <br /> already do. Mr. Baumann said the primary reason is to allow the restaurant to obtain a liquor <br /> license so they can serve alcoholic beverages. <br /> There were no objectors present. <br /> It was moved and seconded(Dial/Harris)to forward Calendar No. 14-26 to t e City Council with <br /> a recommendation for approval. Motion carried unanimously. <br />
