ORDINANCE NO.2014- 4 2 <br /> ORDINANCE AUTHORIZING CONSUMPTION OF ALCOHOLIC <br /> LIQUOR ON PUBLIC RIGHT-OF-WAY— <br /> DECATUR AREA ARTS COUNCIL BREW HA HAI <br /> WHEREAS, the Decatur Area Arts Council Brew Ha Ha event,will be held on the public <br /> sidewalk and street in front of 125 North Water Street Saturday, September 27, 2014 from 5:00 <br /> p.m. —Midnight.; and, <br /> WHEREAS, it is the intention of the Decatur Area Arts Council to offer alcohol for the <br /> sale to its patrons in a tent in front of the Madden Arts Center at 125 North Water Street, <br /> Decatur, Illinois, for consumption at the Brew Ha Ha; and, <br /> WHEREAS, such consumption of alcoholic liquor on public rightsiof--way requires the <br /> express approval of the City Council; and, <br /> WHEREAS, the Council finds that it would be in the best interest of the Decatur Area <br /> Arts Council and of the City of Decatur that such consumption of alcoholic liquor as described <br /> be permitted for said limited time period. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section L That on the days listed herein, and only on such day, between the hours listed <br /> opposite said day, alcoholic beverages may be consumed at, in or on thoseportions of public <br /> rights-of-way described in Section 2 hereof, said days and hours being partcularly described as <br /> follows: <br /> Saturday, September 27, 2014 5:00 p.m.—Midnight <br /> Section 2. That no alcoholic liquor may be consumed as provide herein unless such <br /> alcoholic liquor is in a plastic or paper cup. <br /> Section 3. That this ordinance is expressly conditioned and approved upon the Decatur <br /> Area Arts Council providng to the City of Decatur an agreement which will hold the City of <br /> Decatur harmless for any and all damages incurred by persons attenc ing this event and <br /> indemnifying the City for any and all damages and lawsuits. <br /> Section 4. That except as otherwise provided herein, the provisions of Section 34 (a) of <br /> Chapter 52 of the City Code remain in full force and effect. <br />
