r
LEGAL DEPARTMENT MEMORANDUM
NO. 2014-03
July 28, 2014
TO: Honorable Mayor McElroy and City Council
FROM: Ryan McCrady, City Manager
Wendy Morthland, Corporation Counsel
Amy Waks, Assistant Corporation Counsel
SUBJECT: Amendments to Chapter 48, Section 8 —Weeds
RECOMMENDATION: Staff requests that Council pass the proposed
ordinance amendment regarding Chapter 48, Section 8. The amendment will
more clearly define what property an owner is responsible to maintain, adding
property adjacent to sidewalks. Further, the amendment will allow for water
usage to determine what notice of violation is required to be given to a
property owner/tenant prior to the City mowing a property. Prior to this
amendment, active water service was the only determining factor seven if the
property is clearly vacant. This amendment will allow actual water usage to
be a determination in addition to or a substitute for active water service.
POTENTIAL OBJECTIONS: There are no known or expected objections.
INPUT FROM OTHER SOURCES:
STAFF REFERENCE:
Amy Waks, Assistant Corporation Counsel, at 424-2807.
BUDGET/TIME IMPLICATIONS: None
