ORDINANCE NO. 2014-17 <br /> CITY OF DECATUR, ILLINOIS <br /> ORDINANCE TO ESTABLISH A PUBLIC HEARING DA'V'E <br /> FOR THE FOURTH AMENDMENT TO THE <br /> DECATUR SOUTHEAST PLAZA <br /> TAX INCREMENT FINANCING(TIF) DISTRICT <br /> WHEREAS, the statutes of the State of Illinois by the "Tax Incrment Allocation <br /> Redevelopment Act", 65 ILCS 5/11-74.4-1 et. seg., as amended, hereinafter referre to as the "Act", <br /> provides for municipalities to create within their corporate boundaries tax increment financing <br /> redevelopment areas and to amend such areas; and <br /> WHEREAS, on May 5, 1997, the City of Decatur, Macon County, Illinois (the "City"), an <br /> Illinois Home-Rule municipality, by its duly elected Mayor and City Council heretofore adopted a <br /> Redevelopment Plan and Projects;designated a Redevelopment Project Area("Area' ;and adopted Tax <br /> Increment Financing pursuant to the TIF Act for the Decatur Southeast Plaza Tax In rement Financing <br /> (TIF) District; and <br /> WHEREAS, the City has determined that the stable economic and physiclal development of <br /> certain areas within the City continue to be endangered by the presence of blightini and conservation <br /> factors as defined in said Act; and <br /> WHEREAS,pursuant to the Act and the City's Home-Rule authority,the Ciiy desires to further <br /> amend the Redevelopment Plan and Projects for the Decatur Southeast Plaza TIP District ("Fourth <br /> Amendment");and <br /> WHEREAS, pursuant to Section 11-74.4-4.2 of the Act, the City approved Ordinance No. <br /> 2000-40 on May 15, 2000, authorizing the establishment of a Tax Increment Fi ncing "Interested <br /> Parties Registry"and adopted Registration Rules with regard to such Registry for FTIF District;and <br /> WHEREAS, pursuant to Section 11-74.4-5 of the Act, the City Council gust cause a Public <br /> Hearing to be held on the proposed Fourth Amendment to the Redevelopment Plan and Projects;and <br /> WHEREAS,pursuant to Section 11-74.4-5(c)of the Act,the City shall provide notice not less <br /> than 45 days prior to the date set for the Public Hearing to each taxing district whichlevies a tax within <br /> the Area and the Illinois Department of Commerce and Economic Opportunity(ICEO) by certified <br /> mail. Said notice of the Public Hearing shall include the date,time and location of the Public Hearing, <br /> and an invitation to each taxing district and DCEO to submit written comments to the City,in care of <br /> the City Clerk of the City of Decatur, City Hall, #1 Gary K. Anderson Plaza,De atur,Illinois 62523 <br /> concerning the subject matter of the Public Hearing prior to the date of the Publi�Hearing;and <br /> WHEREAS, pursuant to Section 11-74.4-6 (65 ILCS 5/11-74.4-6) of th Act, the City shall <br /> provide notice of this Public Hearing by publication and mailing. Notice by publi ation shall be given <br /> at least twice, the first publication to be not more than 30 or less than 10 days prior to the Public <br /> Hearing in a newspaper of general circulation within the taxing districts in the Are ,and said notice by <br /> mailing to be given by depositing such notice in the United States mail by certifie mail addressed to <br /> the person or persons in whose name the general taxes for the last preceding year w re paid on each lot, <br /> block,tract,or parcel of land lying within the Area,not less than ten(10) days prior to the date set for <br /> the Public Hearing; and <br /> Decatur SE Plaza TIF District-4`n Amendment Page 1 of 2 <br />
