Ilinois <br /> S.S. by Mary A. tat n, Recorder <br /> "� s J Book: 4401 age: 725 <br /> I I L E® Receipt r: 66006 Recording Fee <br /> @) Pages Recorded: 2 Authorized By <br /> 5 2014 Date Recorded: 11/5/X14 8:57:00 AM <br /> ;;EFHEN iVl.BEAN IIIIII IIIIIIIIIIIIIIIIIIIIIII IIIIIIIII VIII IIIIIII III VIII IIIIIIII Iiil III <br /> ;Q�If Ty r1.EF� BACON COI.INTY <br /> ORDINANCE NO. 2014-07 <br /> ORDINANCE AMENDING B-2 COMMERCIAL DISTRICT PLANNED UNIT <br /> DEVELOPMENT (PUD) LOCATED AT 4040 WEST FOUNTAIN LANE <br /> WHEREAS, on the 6 1 day of March, upon due notice, the Decatur 2ity Plan <br /> Commission held a public hearing upon the petition of MDA Development Holdings, <br /> LLC, to amend the B-2 Commercial District Planned Unit Development for premises <br /> legally described as: <br /> Lots One (1) and Two (2) of Cardwell Crossing, as per Plat recorded in <br /> Book 1832, Page 863 of the Records in the Recorder's Office of Macon <br /> County, Illinois. <br /> AND <br /> WHEREAS, the Decatur City Plan Commission recommended that the prayer of <br /> said petition be granted. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section 1. That the recommendation of the Decatur City Plan Comnlission be, and <br /> the same is hereby, received, placed on file and approved. <br /> Section 2. That the B-2 Commercial District Planned Unit Development for said <br /> above described premises commonly known as 4040 West Fountain Lane tie, and they <br /> are hereby, amended with the following conditions: <br /> a) Signage shall be in accordance with the originally approved B-2 Pt D. <br /> b) Prior to site plan approval, recorded documentation that the private ingress/egress <br /> easements have been vacated shall be submitted. <br /> c) Final site, landscaping and lighting plans shall be submitted to and approved by <br /> the Economic and Urban Development Department, the Department of <br /> Engineering and Infrastructure and the Fire Department prior to building permits <br /> being released. <br /> Section 3. That the Districts hereinabove mentioned are those distri is set forth <br /> and defined in Ordinance No. 3512 of the City of Decatur, Illinois, commo ly known as <br /> the Zoning Ordinance, and all the provisions, regulations, restrictions and requirements <br /> therein set forth shall apply to the premises above described herein. <br /> Section 4. That the zoning of said premises as set out herein shall be shown and <br /> verified on the Zoning District Map as in such Ordinance No. 3512 provided and said <br /> Districts be, and they are hereby, amended and changed as herein set forth. <br />
