Illinoi 1862664 S.S. by Mary A. baton, hcorder Book: 4334 Pa e: 80 Receipt e:Recorded: Recording Fee: 130.00 9At Pages Recorded: 3 Au horized By L�� Date Recorded: 10/7/20 8:49:09 AM ORDINANCE NO. 2013-75 ORDINANCE VACATING PUBLIC RIGHT-OF-`VA - NORTH PINE STREET - WHEREAS, a request has been received from Mercer Rentals, L C, requesting the vacation by the City Council of public right-of-way in the City of Deca ur, Illinois legally described as: Beginning at an iron pin located at the intersection to the South Right f Way line of Green Street and the East Right of Way line of North Pine Street, in the City of Decatur, Illinois, running thence South along the East Right of Way line of said North Pine Street, 166 feet, more or less, to a point on the North line o the tract previously owned by the Illinois Central Railroad Company, said poin also being the Northeast corner of the previously vacated North Pine Street by Ordinance No. 5888 Recorded in Book 1787, Page 59 of the Records in the Recorder's Office of Macon County, Illinois; thence Northwesterly along the Norlh line of said previously vacated North Pine Street to a point of intersection oft Lie said North line of the tract previously owned by the Illinois Central Railroad Company and the West Right of Way line of said North Pine Street; thence North along the said West Right of Way line of North Pine Street, 133 feet, more or le s, to the intersection of the said South Right of Way line of Green Street and th said West Right of Way line of North Pine Street; thence East 60 feet to the point of beginning, subject to the right of the public to such utility easements a may now exist in, over, along and under said street requested to be vacated; and, WHEREAS, said public right-of-way is no longer useful to the public or to the City or to the owner of the property abutting thereon as public right-of way; and, WHEREAS, the public interest will be subserved by vacating said public right-of-way and the public will be relieved from the further burden and responsibility of maintaining the same. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That upon the conditions set forth below, the above descri ed public right-of- way be, and the same is hereby, vacated inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation, said public right-of-way being shown on the plat thereof hereto attached and hereby made a part hereof. A. All easements shall be maintained.
