Excerpts from Plan Commission Minutes of August 1,2013:
Cal. No. 13-44 Petition of MERCER RENTALS LLC to vacate the
700 BLOCK of NORTH PINESTREET Right-of-
Way.
Ms. Stickle presented the recommendation of staff:
The petitioner is requesting to vacate the approximately north 166 feet of the 700 Block of
North Pine Street Right-of-Way (ROW). The Right-of-Way to be vacated is approximately
9,019 square feet in area. The entire ROW to be vacated has an improved concrete surface. The
petitioner owns property on all sides of the ROW.
The vacation will enable the petitioner to control the ROW and utilize the area as part of their
property.
The southern portion of this ROW was vacated by City Council in 1973. The urrent ROW to be
vacated serves no purpose to the general public as it only leads into the petitioner's property.
Letters were sent to Ameren Illinois, Comcast Communications, and AT&T notifying the utility
companies of the vacation request and no objections to the proposed Right-of-Way vacation
were expressed. All easement will be maintained.
An appraisal was commissioned for the approximately 9,019 square foot Ri ht-of-Way with a
market value of$5,000.00. The petitioner will pay the City of Decatur $5,0 0.00 to vacate the
700 Block of North Pine Street Right-of-Way.
The formal vacation of this ROW does not appear that it will have an adv rse affect on the
general public.
Staff recommends approval of the Right-of--Way vacation with the following c ndition:
a. All easements shall be maintained.
A motion to forward the vacation request of Calendar Number 13-44 to the C ty Council with a
recommendation for approval is suggested.
Mr. Cochran stated that Dunn Company is a long time Decatur company have purchased
property adjacent to the company over the years. This petition will allow their company to grow
in the future and have control of this property. All of the requirements have been met and they
are agreeable to the $5,000.00.
There were no questions and no objectors present.
It was moved and seconded (Frantz/Peck) to forward Calendar No. 13-44 to the City Council
with recommendation for approval as submitted. Motion carried unanimously.
