The petitioner is requesting to vacate the approximately north 166 feet of the 700 Block of North Pine Street Right-of-Way (ROW). The Right-of-Way to be vacated is appro imately 9,019 square feet in area. The entire ROW to be vacated has an improved concrete surface. The petitioner owns property on all sides of the ROW. 2. The vacation will enable the petitioner to control the ROW and utilize the area as part of their property. 3. The southern portion of this ROW was vacated by City Council in 1973. The current ROW to be vacated serves no purpose to the general public as it only leads into the petitioner's property. STAFF ANALYSIS 1. Letters were sent to Ameren Illinois, Comcast Communications, and AT&Tnotifying the utility companies of the vacation request and no objections to the proposed Right-of-Way vacation were expressed. All easement will be maintained. 2. An appraisal was commissioned for the approximately 9,019 square foot Right-of-Way with a market value of$5,000.00. The petitioner will pay the City of Decatur $5,00).00 to vacate the 700 Block of North Pine Street Right-of-Way. 3. The formal vacation of this ROW does not appear that it will have an adverse affect on the general public.
