Marley, P.E., Director of Public Works
SUBJECT: Ordinance Prohibiting The Use Of Groundwater As A Potable Water Supply
By The Installation Or Use Of Potable Water Supply Wells Or By Any Other
Method Within A Certain Area In The City Of Decatur
SUMMARY RECOMMENDATION:
It is recommended that the City Council approve the attached Ground Water dinance prohibiting
the use of groundwater as a potable water supply for the former Dougherty Oil Company site
located at 3429 North 22nd Street.
PRIOR COUNCIL ACTION:
There have been no prior Council actions regarding ground water contamination for the former
Dougherty Oil Company site located at 3429 North 22nd Street.
Prior Council Action on Ground Water Ordinances:
Since 2002, the City Council has authorized 19 ground water ordinances at various locations in the
City.
BACKGROUND:
Ground Water Ordinance:
City staff was contacted by Midwest Environmental Consulting &Remediation Services, Inc. (letter
attached who represents the owner of the
), ep a former Dougherty Oil Company loc ted at 3429
22nd
gh Y p Y North
22 Street regarding their
g g remediation efforts resulting from chemicals that have infiltrated into the
ground from leaking petroleum tanks at the site for many years.
A Ground Water Ordinance is a tool used by the Illinois Environmental Protect' n Agency(IEPA)
to remediate properties where soil and ground water under the site have been co itarninated by
chemicals. The ordinance prohibits the use of groundwater as a potable water si tpply for the area
identified on Exhibit A as having the maximum potential for ground water cont, mination from
petroleum that was released from the site over the years.
The major benefit of a ground water ordinance is that it serves to keep contamin ited water isolated
underground and not allow it to be used for human consumption. The ground water use prohibition
area is served by the City's public water supply so the prohibition will not create a hardship for area
residents or businesses.
Page 1
