DEVELOPMENT SERVICES MEMORANDUM
No. 13-61
July 31, 2013
TO: Honorable Mayor Michael T. McElroy and City Council
FROM: Ryan P. McCrady, City Manager
Billy Tyus,Assistant City Manager
Suzan M. Stickle, Senior Planner
SUBJECT: Right-of-Way Vacation North Edgewater Drive
SUMMARY RECOMMENDATION: Staff recommends approval with the following conditions:
1. All easements shall be maintained.
2. If a gate is installed across the Right-of-Way, a knox box shall be installed to allow emergency
vehicles access.
The City Plan Commission voted 8-0 to recommend approval of this petition it the July 11, 2013
meeting;the minutes of the meeting are attached.
BACKGROUND: The petitioner is requesting to vacate all of the North Edgewater Drive Right-of-Way
(ROW) located South of East Parkway Drive. The Right-of-Way to be vacated is approximately 15,557
square feet in area. The northernmost approximately one-third of the ROW has an improved concrete
surface. The petitioner owns property on the south side of the ROW. The other adjacent property owners
have been notified of the proposed vacation and no objections have been expressed.
North Edgewater Drive currently serves as the sole access to the ADM intermodal yard. The current
configuration of the ROW does not allow for traffic to turn around without entering ADM's property.
The vacation of the ROW would allow ADM to use North Edgewater Drive as the driveway to the
intermodal yard and discourage the use of their property as a turnaround for the other traffic.
The formal vacation of this alleyway does not appear that it will have an adverse affect on the general
public.
Letters were sent to Ameren Illinois, Comcast Communications, and AT&T notifying the utility
companies of the vacation request and no objections to the proposed Right-of-Way vacation were
expressed. All easements shall be maintained.
An appraisal was commissioned for the approximately 15,557 square foot Right- f-Way with a market
value of $6,700.00. A second appraisal was commissioned with a market value of $9,300.00. The
petitioner will pay the City of Decatur$8,000.00 to vacate the North Edgewater Drive Right-of-Way.
POTENTIAL OBJECTION: There were no known objectors at the Plan Commis ion Meeting.
INPUT FROM OTHER SOURCES: The Right-of-Way vacation has been reviewed by the City's
Technical Review Committee; Planning, Engineering and Fire have approved the v ation.
STAFF REFERENCE: Any additional questions may be forwarded to Suzan M. Rickle at 424-2786 or
at smstickle@decaturil.gov.
BUDGET/TIME IMPLICATIONS: None.
i
