ORDINANCE NO. 2013-62 ORDINANCE AMENDING CONDITIONAL USE PERMIT - 2505 NORTH MAIN STREET - WHEREAS, on the 6th day of June, 2013, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Trevor Stalets and Julie Stalets, to modify and amend the Conditional Use Permit previously approved by Ordinance No. 2012-08 to relocate the Automated Teller Machine (ATM) on property located in the City of Decatur, Illinois and legally described as follows: Lots One (1) thru Four (4) and the East 5.23 feet of Lots Five ( ) through Eight (8) all in Block Eleven (11) of Pythian Home Addition of Outlots to the City of Decatur, as per Plat recorded in Book 300, Page 19 of the records in the Recorder's Office, Macon County, Illinois; and, The 20 foot of the previously vacated public alley lying between said lots; and, The vacated public alley adjacent to Lot "D" in said Pythian Home Addition of Outlots; and, WHEREAS, the Decatur City Plan Commission did report its findings and did recommend that the amendment of said Conditional Use Permit as requested be authorized. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNC IL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the report and recommendation of the D catur City Plan Commission be, and the same are hereby, received, placed on file and approved. Section 2. That except as modified by the provisions hereof, the heretofore ordained Conditional Use Permit, and the provisions of Ordinances relating thereto as heretofore amended and modified remain in full force and effect and the same remain subject to all conditions, limitations and restrictions set out in the Orc inance aforesaid and the respective modifications and amendments thereto.
