ORDINANCE NO. 2013-48 <br /> ORDINANCE GRANTING CONDITIONAL USE PERMIT <br /> - 2243 NORTH MAIN STREET - <br /> WHEREAS, on the 2nd day of May, 2013, upon due notice, the ecatur City Plan <br /> Commission held a public hearing upon the petition of Carla Turner-Wells for a conditional use <br /> permit under the provisions of Section XXII.A.2 of the Zoning Ordinance to allow the operation <br /> of a Day Care Home, Large in a R-3 Single Family Residence District on property located in the <br /> City of Decatur, Illinois and legally described as follows: <br /> Lot Twenty-Nine (29) of Butler Heights Addition, an Addition to the City of <br /> Decatur, as per Plat recorded in Book 335, Page 610 of the Records in the <br /> Recorder's Office of Macon County, Illinois; and, <br /> WHEREAS, said Decatur City Plan Commission recommended that such conditional use <br /> permit be approved. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the recommendation and report of the Decatur City Pl�n Commission be, <br /> and the same are hereby, received, placed on file and granted. <br /> Section 2. That upon the conditions set forth below a conditional use permit be, and it is <br /> hereby, granted to Carla Turner-Wells and only to Carla Turner-Wells to allow the operation of a <br /> Day Care Home, Large in the R-3 Single Family Residence District upon the premises aforesaid <br /> in accordance with the plat thereof hereto attached marked Exhibit A and hereby made a part <br /> hereof. <br /> 1. That the proposed operation be limited to a maximum of eight (8) children. <br /> 2. That the proposed operation be in compliance with applicable provi ions of the City's <br /> adopted Building Codes, including obtaining a building permit to per orm any proposed <br /> or required improvements to the existing dwelling. <br /> 3. That the proposed daycare be at all times appropriately licensed by the State of Illinois. <br />
