Excerpts from Plan Commission Minutes of May 2, 2013: <br /> Cal. No. 13-13 Petition of DECATUR MEMORIAL HEALTH <br /> FOUNDATION, to rezone property located at 2122 <br /> NORTH 27" STREET from M-I Intense <br /> Commercial/Light Industrial District to 0-1 Office <br /> District. <br /> Ms. Suzy Stickle was sworn in by Mrs. Janet Poland. <br /> Ms. Stickle presented the recommendation of staff: <br /> The approximately seven and one-half acre (7.5) subject site is located at 2122 North 27th Street and <br /> is currently developed with a medical office and walking/running track. <br /> The petitioner proposes to rezone from M-1 Intense Commercial-Light Indust: rial District to 0-1 <br /> Office District in order to construct a pocket park as well as add a new 400 metre track and an <br /> extension to the existing track. In the O-1 Office District, both parks and imedical offices are <br /> permitted uses. <br /> The surrounding zoning includes R-3 Single Family Residence District to the south, M-1 Intense <br /> Commercial/Light Industrial to the west and M-2 Heavy Industrial District to the north and east. <br /> The Decatur Urban Area Land Use Plan shows this area as Employment. The existing use and <br /> proposed use are compatible with adjacent uses to the north, south and west. The rezoning of this <br /> property to 0-1 Office District should not have an adverse effect of the surrounding area. Nor <br /> should the surrounding uses to the north, south and west have an adverse effect,on the proposed use <br /> as a pocket park. <br /> Staff recommends approval of the rezoning. <br /> Section XXIX. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a <br /> public hearing on a rezoning request, and then forward its report and recommendation to the City <br /> Council for final approval. A motion to forward Calendar Number 13-13 to the City Council with a <br /> recommendation for approval is suggested. <br /> Mr. Phil Cochran, representative, was sworn in by Mrs. Poland. <br /> Mr. Cochran stated ADM has been expanding their rail facilities on the north side of Faries <br /> Parkway and also have expanded to the west. The School District sold Spencer School to ADM <br /> several years back. ADM has also acquired Spencer Park through the Decatur Park District which <br /> is north of the school. The Park District has committed to construct a pocket pork in the area as part <br /> of this sale. The Decatur Memorial Health Foundation owns a 7.5 acres parcel in the area and has <br /> agreed to allow the Decatur Park District to build a pocket park. The existing M-1 Zoning does not <br /> allow for a park and this is the reason for the request for the property to bO rezoned to an 0-1 <br /> District. <br /> Chairman Glenn Livingston asked if the park would consist of a jogging/walking path, half <br /> basketball court and an open pavilion. Mr. Cochran said yes and there would also be parking <br /> available. <br /> Mr. Bruce Frantz asked who would maintain the park. Mr. Cochran stated the Nark District. <br /> There were no objectors present. <br /> It was moved and seconded (Myatt/Frantz) to forward Calendar No. 13-13 to the City Council with <br /> recommendation for approval as submitted. Motion carried unanimously. <br />
