ORDINANCE NO. 2013- 19 <br /> ORDINANCE AMENDING THE DECATUR MACON COUNTY ENTERPRISE ZONE <br /> -TERMINATION DATE- <br /> -TAX ABATEMENT- <br /> WHEREAS, the City of Decatur, by and through its Ordinance 2012-93 approved participation <br /> in the Decatur Macon County Enterprise Zone and agreed to participate in targeted <br /> property tax abatement in accordance with the requirements of Public Act 97-0905, and, <br /> WHEREAS, Ordinance 2012-93 reflected an incorrect statutory termination date, and, <br /> WHEREAS, the Administrator of the Decatur Macon County Enterprise Zone has <br /> requested a correction of the affected language, and <br /> WHEREAS, further clarification is required related to development projects where <br /> Enterprise Zone boundaries overlap with designated and approved Tax Increment Finance (TIF) <br /> districts, <br /> NOW,THEREFORE, BE IT ORDAINED BY THE DECATUR CITY COUNCIL <br /> Section 1. That all references in City of Decatur Ordinance 2012-93 containing the following <br /> language "........to automatically extend the certification of the Decatur Macon County <br /> Enterprise Zone through December 31, 2016, and subject to applications yet to be submitted <br /> through December 31, 2041" are to be replaced with following language: ".....to automatically <br /> extend the certification of the Decatur Macon County Enterprise Zone through July 1, 2016." <br /> Section 2. This Ordinance, and every provision hereof shall be considered separable; <br /> and the invalidity on any section, clause, paragraph, sentence or provision of the <br /> solution shall not affect the validity of any other provisions of this Ordinance. <br /> Section 3. All Ordinances or parts of Ordinances conflicting with any provisions of this <br /> Ordinance shall be and the same are, hereby repealed. <br /> Section 4. This Ordinance shall be in effect from and after its passage, approval and recording <br /> according to law. <br /> Section 5. In the case of properties located within a redevelopment project area or tax <br /> increment financing district created pursuant to Real Property Tax Increment Allocation <br /> Redevelopment Act (65 ILCS 5/11-74.4-1 et seq), no abatement of taxes under Section 18-170 <br />
