<br /> PETITION REGARDING ANNEXATION OF CERTAIN TERRITORY
<br /> TO THE CITY OF DECATUR ON APRIL 1, 2013
<br /> COMES NOW the Harristown Fire Protection District by its attorneys, Parish&Castleman
<br /> LLP, and for its Petition Regarding Annexation of Certain Territory to the Cityi of Decatur, pursuant
<br /> to 70 ILCS 705/20, states:
<br /> 1. Harristown Fire Protection District,Petitioner,is a duly organized fide protection district
<br /> under the laws of Illinois,located entirely in Macon County.
<br /> 2. The City of Decatur, Illinois, Defendant,is a municipal corporation, duly organized under
<br /> the laws of Illinois and is located in Macon County, Illinois.
<br /> 3. On April 1, 2013,the City of Decatur, Illinois,by action of its Counci ,passed Ordinance No.
<br /> 2013-14, annexing into the corporate boundaries of the City of Decatur,the fo owing described real
<br /> estate:
<br /> The north 236.1 feet of Lot 7 of West Sunnyside Heights Second Addition, as per plat
<br /> recorded in Book 982,page 73, of the records of the Macon County Re rder, except
<br /> that part dedicated to the Decatur Township Highway Commissioner,by instrument
<br /> recorded on August 20, 1973, as Document 943349, situated in Macon County,Illinois;
<br /> commonly known as 38o1 W. Center St., Decatur,IL 62526;
<br /> Tax ID No. 04-12-07-201-013
<br /> 4. The Harristown Fire Protection District objects to said annexation and the disconnection
<br /> of the above-described real estate from its territory because such disconnection may cause the
<br /> territory remaining in the District to be noncontiguous and that the loss of assossed valuation by
<br /> reason of such disconnection will impair the ability of the District to render fury adequate fire
<br /> protection service to the territory remaining within the District.
<br /> WHEREFORE,the Petitioner respectfully prays that the action of the 6ty of Decatur, Illinois,
<br /> in annexing the property described herein be declared invalid as to the Petitioner and prays the Court
<br /> to order that the said property shall remain within the Harristown Fire Protec on District.
