Excerpts from Plan Commission Minutes of February 7,2013 continued: <br /> explained that the City has legal limits and staff feels we cannot support the conditions they are asking <br /> for. <br /> Mr. Grady asked Mr. Tyus if he was saying that if the City would support these nditions it could risk <br /> litigation from the Pay Day Loan stores. Mr. Tyus said it could open up the City for a legal challenge. <br /> Mr. Bill Clevenger asked if one of these businesses were to leave from one of these sites would the <br /> next business moving in have to conform. Ms. Stickle stated as long as the use remains the same they <br /> would be able to remain in that location. It can change ownership from one o these pay day loans <br /> stores to another type of pay day loan store. <br /> Mr. Dial asked if the businesses are grandfathered in today would each of these sites be able to remain <br /> a pay day loan facility. Mr. John Robinson said as long as there is a continuation of use they can <br /> remain. Once the use is broken the site can no longer be grandfathered in. <br /> Mr. Steve John asked if the grandfathered businesses could double or triple in size. Mr. Robinson <br /> stated they could expand. It is the use that the Zoning Ordinance would allow. Mr. Tyus said they <br /> would have to follow other rules such as setbacks and required parking if they were to expand. <br /> Mrs. Peck asked if these businesses are regulated by the State. Mr. Tyus said yes, <br /> Reverend Stacey Brohard was sworn in by Mrs. Poland. <br /> Reverend Brohad gave an example of a person would was being charged over 4 0 percent interst just <br /> to pay their power bill. He said these businesses are predators in our community. People that are <br /> dealing with severe deficiencies need a voice of fairness to speak for them. Res rictions need to be in <br /> place for these businesses that are coming into our community. Reverend Broh rd said he would like <br /> the Plan Commission to support this and also do more in the future. <br /> There were no objectors present. <br /> It was moved and seconded (/Dial/Frantz) to forward Calendar No. 12-49 to t e City Council with <br /> recommendation for approval as submitted. Motion carried unanimously. <br />
