PUKPhi I lip w. cochran: consulting engineer
December 13, 2012
Ms. Suzy Stickle
City of Decatur
#1 Gary K. Anderson Plaza
Decatur, IL 62523
Subject: Fishermen's Wharf Addition
Decatur Park District Subdivision
PWC Project: 730
Dear Ms Stickle:
Attached is a subdivision which proposes to subdivide a portion of property owned by
the Decatur Park District which lies between existing privately owned property (subdivision lots)
and Lake Decatur property owned by the City of Decatur. This property is not useable property
by the Park District and has been used by some of the adjacent property owners. The Park
District is merely trying to sell off the unusable property to the adjacent contiguous owner.
Obviously this is a unique situation. None of the lots have frontage onto a public road
right of way; they do however have frontage onto Lake Decatur. Lot 4 does not have the
minimum lot width of 50 feet as required by the Zoning Ordinance for R-3 property. Once
again the uniqueness of the situation has dictated the lot size as Lot 4 is only 38.26 feet wide
which matches the lot dimension of Lot 8 of South Shores 3rd Addition, the Lot which Lot 4 is
contiguous. Additionally, because of the similar circumstance, Lot 4 is only 4594 square feet in
size, smaller than the Zoning Ordinance requirement of 6,000 square feet for lots in R-3 zoned
property.
This subdivision is certainly unconventional because the subdivision ordinance does not
allow the Park District to sell off property to adjacent owners without going through the
subdivision process. The State of Illinois Plat Act allows the sale of property to an adjacent
owner under certain circumstances, this situation meets those circumstances.
Please advise if you have any questions. I will be present at all meetings to represent
the Park District.
ayours
R
000/
Phillip W.
