LEGAL DEPARTMENT MEMORANDUM
NO. 2012-14
December 21, 2012
TO: Honorable Mayor McElroy and City Council
FROM: Ryan McCrady, City Manager
Wendy Morthland, Corporation Counsel
Mike Frazier, Assistant Corporation Counsel
SUBJECT: Chapter 48 —Nuisances
SUMMARY RECCOMENDATION: Staff proposes amendments to the City Code at Chapter
48 —Nuisances.
BACKGROUND: By state law, neighborhood inspectors may cite a violator for having a weeds
nuisance by posting notice of the violation on the property. The city recently purchased ticket
books for the neighborhood inspectors to use, as part of the city's enforcement efforts through
administrative hearings. The proposed ordinance change allows neighborhood inspectors to post
the tickets on the property, alerting the occupant of the weeds nuisance.
State statute allows municipalities to remove nuisance greenery by cutting weeds or grass,
trimming trees or bushes or removing nuisance trees or bushes. The proposed change makes
explicit the City's nuisance abatement authority, in conformity with state law.
POTENTIAL OBJECTIONS: There are no known or expected objections.
INPUT FROM OTHER SOURCES: None
STAFF REFERENCE: Mike Frazier, Assistant Corporation Counsel, at 424-2807.
BUDGET/TIME IMPLICATIONS: None
cc: John Robinson
Amy Waks
