AMENDMENT TO THE "OPERATION UPLIFT" AGREEMENT This Amendment to the Agreement is made and entered into by and between the City of Decatur, Illinois, a municipal corporation hereinafter referred to as the "City", and AOK Travel Network, Inc., an Illinois corporation, authorized to do and doing business in the; City of Decatur as a livery company, and hereinafter referred to as the "Livery Company". WHEREAS the City and the Livery Company entered into an Agreement; executed on October 1, 2012, under which the City will pay fare subsidies directly to the Livery Company for all eligible rides provided by the Livery Company, in lieu of fare subsidy reimbursements to each individual Operation Uplift rider for each eligible ride; and WHEREAS the Agreement specified the fares that may be charged by the Livery Company to Operation Uplift participants during the term of the Agreement; and WHEREAS the Livery Company has requested an amendment of the Agreement to add a $2.50 surcharge for each trip made by a rider in a wheelchair, electric scooter, or similar mobility aid, in the company's wheelchair accessible van under the Transit System's Operation Uplift program. NOW THEREFORE, for and in consideration of the promises, covenants, agreements and conditions hereinafter set forth to be performed, kept and met by the respective parties hereto, this Amendment to the Agreement is made by and between the City and the Livery Company as follows: Section 1. of FARES AND SUBSIDIES of the Agreement shall be amended as follows: 1. The fares charged by the Livery Company to Operation Uplift participants during the term of this Agreement shall always be the same as the fares charged by the Livery Company to the general public. A surcharge of$2.50 per trip may also be charged for trips made by a rider in a wheelchair, electric scooter, or similar mobility aid, riding,in the Livery Company's wheel- chair accessible van. The Livery Company's fares as of the date of this Amendment are shown in the table below. The Livery Company may change those fares from time to time, as provided in Chapter 60 of the Decatur City Code. First Passenger, trips within Decatur $10.00 First Passenger, trips to Forsyth $15.00 Each additional passenger, 5 years of age and older $2.00 Each additional passenger, less than 5 years of age FREE Personal Care Attendant(PCA) FREE Surcharge for trips made by a rider in a wheelchair* using a wheelchair accessible van $2.50 (*including electric scooters and similar mobility aids) - 1 -
