RESOLUTION NO. R 2013-59 <br /> RESOLUTION AUTHORIZING CHANGE ORDER NO. 1 <br /> WITH OTTO BAUM COMPANY, INC. FOR <br /> CENTRAL PARK STREETSCAPE & OPEN SPACE ENHANCEMENT PROGRAM <br /> CITY PROJECT 2012-14 <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1. That the Contract between Otto Baum Company, Inc. and the City of Decatur <br /> be, and the same is hereby, modified and amended to authorize Change Order No. 1 for an <br /> additional amount of$32,559; and a total not-to-exceed project cost of$1,767,581.08. <br /> Section 2. That the Mayor and City Clerk be, and they are hereby, authorized and <br /> directed to execute said Change Order No. 1, on behalf of the City of Decatur. <br /> Section 3. That the changes in the above-described Contract are germane to said <br /> Contract, as signed, and such Change Orders are in the best interest of the City of Decatur and <br /> are authorized by law. <br /> Section 4. That the Director of Public Works hereby certifies that the additional work <br /> was not foreseeable at the time said Contract was bid and let. <br /> PRESENTED and ADOPTED this 17th day of June, 2013. <br /> "HAL T.
