Marley, Public Works Director <br /> SUBJECT: Resolution Authorizing Amendment to a Lease Agreement with Archer- <br /> Daniels-Midland Company for Parking Garage B <br /> SUMMARY RECOMMENDATIONS: <br /> It is recommended that the City Council approve a resolution authorizing an amendment to a <br /> lease agreement with Archer-Daniels-Midland (ADM) Company for Parking Garage B, and that <br /> the Mayor and City Clerk be, and they are hereby authorized and directed to sign, seal and attest <br /> said amendment to Lease Agreement on behalf of the City of Decatur. <br /> BACKGROUND: <br /> On October 21, 2010, Council approved an agreement with ADM to lease Parking Garage B. <br /> ADM wishes to make improvements to the parking garage by removing three parking attendant <br /> office structures and construct a new security attendant office structure on the first floor. Exhibits <br /> 1 and 2 attached to this memo illustrate the location and nature of the proposed improvements. <br /> ADM will pay all costs of the work, obtain necessary building and demolition permits, pay <br /> prevailing wages, comply with all federal, state and city laws and ordinances, and indemnify the <br /> City and its officers from claims. <br /> Should ADM cease to use Parking Garage B or the lease not be renewed, the new security <br /> attendant office structure shall remain the property of the City. <br /> POTENTIAL OBJECTIONS: None. <br /> INPUT FROM OTHER SOURCES: The amendment has been reviewed by the City <br /> Corporation Counsel. <br /> BUDGET AND STAFF TIME IMPLICATIONS: None. <br /> STAFF REFERENCE: Richard Marley, Public Works Director, at 424-2747 <br /> Page I 1 <br />
