RESOLUTION N0.2013-37 <br /> RESOLUTION EXEMPTING THE LAKE SHORE DRIVE SEWER REHABILITATION <br /> PROJECT, CITY PROJECT 2012-06, FROM THE HOURS OF CONSTRUCTION <br /> LIMITATIONS REQUIRED BY CHAPTER 48 SECTION 12 OF THE CITY CODE <br /> WHEREAS, the Lake Shore Drive Sewer is a system of sewers that extend from the intersection <br /> of Eldorado and 25t'Streets through residential neighborhoods to Lake Shore Drive and to the Sanitary <br /> District of Decatur's interceptor junction located near the City's South Water Treatment Plant; and, <br /> WHEREAS, the City's Sanitary Sewer Master Plan identifies the Lake Shore Drive Sewer as a <br /> Critical Sewer in the City's system; and, <br /> WHEREAS, the Lake Shore Drive Sewer is in a high state of deterioration; and, <br /> WHEREAS, it is in the best interest of the City that the Lake Shore Drive Sewer be repaired; and, <br /> WHEREAS,the Lake Shore Drive Sewer must be repaired by continuous construction processes <br /> that will require 24 hour operation. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That an exemption shall be granted such that City Code Chapter 48 Nuisances, Section <br /> 12, Hours of Construction, shall not apply to the Lake Shore Drive Sewer Rehabilitation Project, City <br /> Project 2012-06, thereby permitting 24 hour construction operations. <br /> Section 2. That the provisions of all Ordinances in conflict with the provisions of this Resolution <br /> which insofar as the same do conflict therewith, an exemption shall be granted. <br /> PRESENTED, and ADOPTED this 15th d of Apr' 2013. <br /> i <br /> 'KAMA <br /> L T.
