(f) ADM shall not sell, resell or give away any raw water provided by <br /> the City under this Agreement, nor shall ADM sell, resell or give <br /> away any water produced at the North Plant, to any person or <br /> entity. All such raw water and produced water shall be used <br /> exclusively for ADM's East and West Plants. Notwithstanding, <br /> ADM may provide water produced at the North Plant to facilities <br /> located in Macon County, Illinois of ADM or any wholly or majority <br /> owned subsidiary of ADM except for facilities of any current or <br /> former "large user' of the City's water system, other than ADM, as <br /> that term is defined in Chapter 64 of the City Code, or any <br /> subsidiary or affiliate of such large user. <br /> (g) Notwithstanding anything herein to the contrary, in the event that <br /> ADM is withdrawing from Lake Decatur the maximum amount of <br /> raw water permitted by Sections 4(a) and 4 (e) hereof and ADM <br /> determines that it requires additional water for its industrial cooling <br /> and process water requirements or for any other purpose, ADM <br /> may obtain such water from its wells (including amounts in excess <br /> of 5 MGD) and any other available source, excluding Lake Decatur, <br /> without penalty or obligation to the City. <br /> 5. Condition of Water. ADM shall take raw water from Lake Decatur "as is" <br /> and without any representation or undertaking by the City as to the quality, condition or <br /> availability of the water. ADM shall be responsible to treat the water at the North Plant <br /> 5 <br />
