DEVELOPMENT SERVICES MEMORANDUM <br /> Memo No. 13-13 <br /> March 4, 2013 <br /> TO: Honorable Mayor Michael T. McElroy and City Council <br /> FROM: Ryan P. McCrady, City Manager <br /> Billy Tyus, Assistant City Manager <br /> SUBJECT: Amendment to Redevelopment Agreement with Niemann Holdings LLC <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the attached resolution <br /> authorizing the Mayor to execute a second amendment to the redevelopment agreement with <br /> Niemann Holdings LLC for the Pines Shopping Center located in the 2200 Block of East William <br /> St. <br /> BACKGROUND: The Decatur City Council approved an agreement with Niemann Holdings LLC <br /> in November 2009 to redevelop the Pines Shopping Center area. As part of the project, Niemann <br /> has completed demolition of the old Save-A-Lot store and replaced it with a new store and <br /> accessory buildings on site. The city's agreement with Niemann helped to facilitate the project, <br /> providing an incentive in the form of partial sales and property tax reimbursement payable on <br /> January 15 of each year. The incentive is calculated based upon sales tax reports provided by the <br /> State of Illinois that until recently were provided upon request and detailed monthly sales taxes <br /> collected and disbursed. The State recently changed the timing of the reports to quarterly, meaning <br /> that the last quarter totals aren't available until mid-February of each year. This amendment would <br /> change the city's pay date to March 15, allowing for a full year's payment as per terms of the <br /> agreement. The amendment would also allow payment to be assigned to Niemann Foods <br /> Incorporated, instead of Niemann Holdings as per a request from the company. Niemann Foods is <br /> an affiliate of Niemann Holdings and actually operates the local Save-A-Lot store. <br /> POTENTIAL OBJECTION: None. <br /> INPUT FROM OTHER SOURCES: N/A <br /> STAFF REFERENCE: Any additional questions may be forwarded to Billy Tyus at 424-2727 or <br /> at btyus@decaturil.gov. <br /> BUDGET/TIME IMPLICATIONS: N/A <br />
