EMPLOYMENT AGREEMENT THIS EMPLOYMENT AGREEMENT(the"Agreement")is entered into by and between the City of Decatur, an Illinois municipal corporation (the "City"), and Ryan P. McCrady, an individual residing (or to reside) in the City of Decatur, County of Macon, State of Illinois (the "Employee"), on this 6th day of October 2008. I. DEFINITIONS. A. "Agreement," as used herein, shall mean the present Employment Agreement, together with any exhibits or schedules attached hereto,made a part hereof and incorporated herein for all purposes by express reference, and any and all amendments hereto made in accordance with the express provisions hereof. B. "Circuit Court," as used herein, shall mean the Circuit Court of the Sixth Judicial Circuit, Macon County, Illinois (or any successor adjudicative body thereto). C. "City." as used herein, shall mean the Cite of Decatur. an Illinois municipal corporation with home rule powers. D. "City Manager," as used herein, shall mean the office of the administrative head of the municipal government of the City (as defined herein) as set forth and described within § 5-3-7 of the Code (as defined herein) (65 ILCS 5/5-3-7 (2008)), as the same may be amended from time to time. E. "Code," as used herein, shall mean the Illinois Municipal Code, 65 ILCS 5/1-1-1 (2008), as the same may be amended from time to time hereafter. F. "Council,"as used herein,shall mean the body of properly elected and lawfully sitting members of the governing body of the City(as defined herein)and as described within the Code(as defined herein). G. "Effective Date,"as used herein,shall mean the date upon which the City(as defined herein),executes the Agreement(as defined herein),following the approval hereof and authorization provided by the Council (as defined herein) at a lawfully constituted meeting thereof, and upon execution hereof by the City (as defined herein), the authorized representative thereof shall insert into the opening paragraph hereof said date of execution. H. "Employee,"as used herein, shall mean Ryan P. McCrady,an individual residing in, or expected to reside in, the City of Decatur, County of Macon, State of Illinois, and a party to this Agreement(as defined herein).
