DECATUR MACON COUNTY ENTERPRISE ZONE <br /> INTERGOVERNMENTAL AGREEMENT <br /> This agreement is made this 13`h day of December 2012, by and between the City of Decatur and <br /> Macon County. <br /> WHEREAS,the City of Decatur(hereinafter referred to as "City") and Macon County <br /> (hereinafter referred to as "County")have adopted ordinances and resolutions establishing an Enterprise <br /> Zone(hereinafter collectively referred to as "the Ordinance") including incorporated portions of the City <br /> of Decatur and unincorporated portions of the County; and, <br /> WHEREAS,the Ordinance was part of the application to the State of Illinois Department of <br /> Commerce and Economic Opportunity (hereinafter referred to as"the Department") for designation of an <br /> Enterprise Zone Act pursuant to Section 18-170 of the Property Tax Code (351LCS 200-170)hereinafter <br /> referred to as"Act"; and <br /> WHEREAS,the City of Decatur Enterprise Zone was certified by the State of Illinois Department <br /> of Commerce and Community Affairs on July 1, of 1983; and recertified for an additional ten year period <br /> beginning July 1, 2003; and <br /> WHEREAS,the Governor signed Senate Bill 3616 as amended into law on August 7,2012, <br /> thereby amending the"Illinois Enterprise Zone Act' (20ILCS 655/1 et. seq.) under the provisions of <br /> Public Act 97-0905,to automatically extend the certification of the Decatur Macon County Enterprise <br /> Zone through December 31,2016, and subject to applications yet to be submitted through December 31, <br /> 2041; and , <br /> WHEREAS,the City and the County desire to operate the Enterprise Zone in an efficient and <br /> effective manner in keeping with the terms of the Act and rules and regulations promulgated by the <br /> Department and the Illinois General Assembly for the operation of an Enterprise Zone. <br /> SECTION 1: GENERAL PROVISIONS <br /> A. The area as previously described in Exhibit"A"of City Ordinance 82-122 as amended shall be <br /> designated as the Enterprise Zone. <br /> B. The name of the Enterprise Zone shall be the Decatur Macon County Enterprise Zone. <br /> C. The Enterprise Zone shall be in effect until midnight on December 31,2016 or until such time as the <br /> Zone has expired or unless decertified by the Illinois Department of Commerce and Economic <br /> Opportunity or repealed by ordinance of the participating governmental entities,whichever is later. <br /> D. The administration of the Enterprise Zone shall be under the jurisdiction of the City of Decatur as <br /> outlined in the administrative agreement with the Economic Development Corporation of Decatur and <br /> Macon County, hereinafter referred to as the EDC. <br /> SECTION Il; ENTERPRISE ZONE ADVISORY BOARD <br /> A. Duties. The Enterprise Zone Advisory Board created during the recertification process in 2003,will <br /> perform the following duties with respect to the Enterprise Zone <br /> 1. Implement, monitor and update established goals and objectives, <br /> 2. Establish procedures for the operation and management of the Zone, including appeals <br /> processes, and recommend and advise on policies for the operation and management of the <br /> Zone and the administration and enforcement of the Ordinance; <br /> 3. Report to the City and County on a semi-annual basis with respect to Zone activities, policies, <br /> procedures; <br />
