Public Works Memorandum
NO. 2012-79
DATE: October 30, 2012
TO: Honorable Mayor McElroy and City Council
FROM: Ryan P. McCrady, City Manager
Richard G. Marley, P.E., Public Works Director
SUBJECT: Right of Entry Agreement with the Illinois Central Railroad Company for the
Inspection of the Garfield Bridge over the Illinois Central Switching Yard
SUMMARY RECOMMENDATION:
It is recommended that the City Council authorize the Right of Entry Agreement with the Illinois
Central Railroad Company(Railroad)to allow City access to inspect the underside of the Garfield
Bridge over the Illinois Central Railroad switching yard located between Martin Luther King, Jr.
Drive and Jasper Street. The Resolution authorizes the City Manager to execute the Agreement, and
for the payment of$750 to the Railroad to prepare and administer the Agreement.
PRIOR COUNCIL ACTION:
There has been no prior action on this Agreement
BACKGROUND:
The City is required to inspect all its bridges every two years. The biennial inspection of the Garfield
Bridge over the Railroad switching yard is currently being completed. For previous inspections
conducted on this bridge over the past 10 years, visual inspection from the ground has been made
using binoculars. This has been acceptable but it is necessary to complete a closer inspection on a
more routine basis to insure the structural reliability of the bridge.
The Railroad requires the City Council to execute a Right of Entry Agreement, along with providing
insurance, and a$750 processing fee. The City will also pay the Railroad to have a Railroad
employee present during the inspection. This additional amount will not be known until the
inspection has been completed and the man hours have been calculated. The cost will be within
staff's administrative spending limit.
The land and the railroad yard under the Garfield Bridge are still owned by the Illinois Central
Railroad Company. In keeping with the Railroad requirements, the resolution authorizes the City
Manager to execute the agreement for the City.
SCHEDULE:
Following approval of the agreement it will be forwarded to the Railroad and an inspection time will
be established.
Page I 1
