COUNCIL MEMORANDUM <br /> #2012-21 <br /> October 31, 2012 <br /> TO: Mayor Michael T. McElroy and City Council <br /> FROM: Ryan P. McCrady, City Manager <br /> SUBJECT: Intergovernmental Agreement between the City of Decatur and Decatur <br /> Park District for Phase One-Part A of Decatur Lakefront Development <br /> SUMMARY RECOMMENDATION: <br /> Council adopt the attached Intergovernmental Agreement (IGA) for Phase One-Part A of the <br /> Decatur Lakefront Development. This is an agreement between the City of Decatur and the <br /> Decatur Park District. The Decatur Park District Board of Trustees adopted the agreement at <br /> their March 7, 2012 meeting. <br /> BACKGROUND: <br /> At their June 22, 2011 meeting, the City Council adopted a general IGA with the Decatur Park <br /> District regarding the development of Nelson Park and the Decatur Lakefront. At their March 5, <br /> 2012 meeting, The City Council adopted an amendment to that IGA to add more specifics on <br /> the revenue and cost sharing for Lakefront Development. This included and agreement to <br /> create a fund for the payment of expenses and deposit of revenues related to the <br /> development. The IGA for consideration at this meeting pertains to the development of the <br /> first phase of new docks and improvements to the promenade in front of the Beach House <br /> Restaurant. In past meetings, both parties have discussed a desire to share in the cost of the <br /> first phase of the development to energize future improvements and private investment in the <br /> area. This agreement memorializes that arrangement and creates the "Decatur Park District <br /> Nelson/Chandler/Lakefront Fund". The fund will be used to receive revenues and pay expenses <br /> for this phase of the development according to the agreements between the City and Park <br /> District. <br /> This agreement does not address the issue of private docks in this area of the lakefront. Also, it <br /> does not have any impact on dock fees, ownership, or construction standards. Those issues will <br /> have to be determined by the City Council and Park District Board of Trustees at future <br /> meetings. <br /> POTENTIAL OBJECTION: <br /> None foreseen. Other issues regarding dock ownership, fees, and construction standards have <br /> met with opposition but this IGA does not affect those issues. <br />
