AGREEMENT
This Agreement is made and entered into by and between the City of Decatur, Illinois, a
municipal corporation hereinafter referred to as the "City", and AOK Travel Network, Inc., an
Illinois corporation, authorized to do and doing business in the City of Decatur as a livery
company, and hereinafter referred to as the "Livery Company".
WHEREAS, as a recipient of U.S. Department of Transportation, Federal Transit Administration
(FTA) funding assistance, and as required by FTA regulations, the City provides complementary
paratransit service for people with disabilities who are unable to use the City's fixed-route bus
system, through vehicles owned and operated by the City, and through user-side subsidies to
disabled passengers who choose to use the services of licensed, private vendors. The City's
complementary paratransit service is hereinafter referred to as"Operation Uplift"; and
WHEREAS the Livery Company is duly licensed by the City as an operator of livery vehicles;
and
WHEREAS the Livery Company is willing and able to accept the responsibilities, obligations
and terms of this Agreement; and
WHEREAS the Livery Company understands and acknowledges that this Agreement does not
grant exclusive rights to the Livery Company, and that the City reserves the right to enter into a
similar agreement with one or more private vendors.
NOW THEREFORE, for and in consideration of the promises, covenants, agreements and
conditions hereinafter set forth to be performed, kept and met by the respective parties hereto,
this Agreement is made by and between the City of Decatur, Illinois, and AOK Travel Network,
Inc., as follows:
PURPOSE AND SCOPE
The purpose of this Agreement is to facilitate the City's complementary paratransit service for
people with disabilities who are unable to use the City's fixed-route bus system, and who choose
to use the transportation services of licensed, private vendors,by establishing a streamlined
method of fare subsidy reimbursements. This Agreement is not intended to establish the
framework for the City's purchase of transportation services from the Livery Company; this
Agreement is intended to establish the most cost effective method of paying user-side fare
subsidies to people with disabilities who choose to use the paratransit services of licensed,
private vendors. Through this Agreement the City will pay fare subsidies directly to the Livery
Company for all eligible rides provided by the Livery Company, in lieu of fare subsidy
reimbursements to each individual Operation Uplift rider for each eligible ride.
- 1 -
