CONTRACT <br /> THIS CONTRACT, made and entered into this 27th day of August , 2012, by and between <br /> the City of Decatur, Illinois, an Illinois municipal corporation, hereinafter called "City", and Great Lakes <br /> Dredge and Dock Company, LLC, a Delaware Corporation authorized to do business in Illinois, <br /> hereinafter called the "Contractor". <br /> WITNESSETH: <br /> That for and in consideration of the payments, covenants, and agreements stated herein, the <br /> Contractor and City agree as follows: <br /> SECTION 1. General Description. <br /> The proposed improvement designated as City Project 2012-30, consists of a pumping <br /> system and pipeline capable of providing a minimum of 7,000 gpm to the City's raw water <br /> pumping station. The pipeline will require installing approximately 9,200 feet of <br /> minimum 18" diameter polyethylene pipe on the surface of the ground and buried under <br /> driveways, sidewalks and roads as noted on the plans. All power requirements shall be the <br /> responsibility of the Contractor. <br /> SECTION 2. Project. <br /> The Contractor shall perform and complete in a good and workmanlike manner all work <br /> required in connection with "SANGAMON RIVER CORRIDOR PIPELINE <br /> PROJECT", CITY PROJECT 2012-30, all in strict accordance with the Contract <br /> Documents; including any and all Addenda prepared by the Engineering Department of the <br /> City, its employees or designees, hereinafter referred to as "Engineer"; including Contract <br /> Drawings, which is marked as Exhibit F; including Contractor's Schedule of Prices, which <br /> is marked as Exhibit A; including Standard Details, which is marked as Exhibit E. The <br /> Contractor shall do everything required by this Contract and the other documents <br /> constituting a part thereof; all are attached herein and incorporated by reference. <br /> SECTION 3. Payment. <br /> Payments are to be made to the Contractor by the City in accordance with and subject to <br /> the provisions embodied in the documents made a part of this Contract. <br /> SECTION 4. Commencement <br /> Work under this Contract shall commence on the date specified in the written Notice to <br /> Proceed from the City to the Contractor. Upon receipt of said Notice, the Contractor shall <br /> diligently and continuously prosecute and substantially complete all work under this <br /> Contract. <br /> SECTION 5. Completion <br /> A Completion Date is in effect for this project in accordance with Section 108 of the <br /> Illinois Department of Transportation, Standard Specifications for Road and Bridge <br /> Construction, current edition. The Completion Date for Phase A — Pipe Installation is 30 <br /> calendar days after the Phase A notice to proceed is issued. The Completion Date for <br /> Phase B — Pump Installation is 14 calendar days after the Phase B notice to proceed is <br /> issued. <br /> 2 <br />
