CONTRACT <br /> At all times when work is being performed Contractor shall have on the job site someone <br /> in their direct employ who is capable of meeting with the Engineer and making decisions. <br /> If authorized by the Engineer,this condition may be satisfied by having a telephone <br /> number or someone who satisfies the above requirements. <br /> SECTION 11. Estimated Quantities And Location Changes <br /> The quantities for this job are estimates only. These estimated quantities are used for <br /> establishing unit prices. The City reserves the right to increase, decrease, or omit any of <br /> the estimated quantities in this project. No additional compensation will be allowed for <br /> these changes. <br /> SECTION 12. Fair Employment Practices <br /> The Contractor must comply with all relevant provisions of the Illinois Human Rights Act, <br /> the Equal Employment Opportunity Act and any other relevant fair employment rules, <br /> laws or ordinances and shall require any and all subcontractors to comply with the same. <br /> A copy of the City's policy and requirements is marked Exhibit C, attached hereto and <br /> incorporated by reference. <br /> SECTION 13. Indemnification <br /> The Contractor agrees to indemnify and hold harmless the City of Decatur, and its officers <br /> and its employees, from and against all liability, claims, demands and expenses, including <br /> court costs and attorney fees, on account of any personal injury, or property damage which <br /> arise out of or are in any manner connected with the work to be performed under this <br /> Agreement,to the extent such injury or damage is caused in whole or in part by, or is <br /> claimed to be caused in whole or in part by the negligent acts, errors or omissions of the <br /> Contractor, any Subcontractor of the Contractor, or any officer employee or agent of the <br /> Contractor. The obligations of this Section shall not apply to damages which the City of <br /> Decatur shall become liable by final judgment to pay to a third parry as the result of the <br /> negligent act, error or omission of the City of Decatur, its officers, employees or agent of <br /> the City of Decatur. <br /> SECTION 14. Inspection <br /> The Contractor shall give sufficient advance notice of placing orders to permit tests to be <br /> completed before the materials are incorporated in the work and he shall afford such <br /> facilities as the Engineer may require for collecting and forwarding samples and making <br /> inspections. All costs connected with the furnishing and testing of samples will be borne <br /> by the Contractor. Independent testing laboratories may be used provided they meet the <br /> approval of the City. <br /> SECTION 15. Lane Closure Permits <br /> It is the Contractor's responsibility to obtain all necessary permits. Any costs incurred in <br /> obtaining these permits are to be incidental to the related contract item. Permit fees will be <br /> waived for those permits issued by the City . <br /> 5 <br />
