(c) failing to advise Service Provider that any certificate of insurance fails to contain <br /> all the required insurance provisions, or is otherwise deficient in any :ni.nuier. <br /> Service Provider agrees that the obligation to provide the insurance required by these documents <br /> is solely its responsibility and that this is a requirement which cannot be waived by any conduct, <br /> action, inaction or omission by the Municipality. <br /> 2. The Municipality does not, in any way, represent that the coverage or limits of insurance <br /> specified are sufficient or adequate to protect the Municipality, or Service Provider, but are <br /> merely minimums. The obligations of Service Provider to purchase insurance shall not, in any <br /> way, limit its obligations.to the Municipality in the event that the Municipality should suffer an <br /> injury or loss in excess of the amount recoverable through insurance, or any loss or portion of a <br /> loss which is not covered by Service Provider's insurance. <br /> 3. In the event Service Provider fails to furnish and maintain the insurance required by this <br /> Contract, the Municipality, upon 7 days written notice, may purchase such insurance on behalf of <br /> Service Provider, and Service Provider shall pay the cost thereof to the Municipality upon <br /> demand or shall have such cost deducted from any payments due Service Provider. Service <br /> Provider agrees to furnish to the Municipality the information needed to obtain such insurance. <br /> 4. All insurance provided by Service Provider shall provide that the insurance shall apply <br /> separately to each insured against whom a claim is made or a suit is brought, except with respect <br /> to the limits of the insurer's liability. <br /> 11 <br />
