- 11 - <br /> no deductions shall be made from the wages or salary of such <br /> employee for that month. <br /> Section 2 . Fair Share Deduction <br /> The City shall deduct from the wages or salary of each <br /> employee in any classification listed in the first page of <br /> this Agreement as being included in the collective bargaining <br /> unit who is not subject to the wage deduction described in <br /> Section 1 of this Article, and at the same time such <br /> deduction is made, an amount certified to the City by the <br /> Union as the fair share of each such employee of the Union' s <br /> cost relating to the collective bargaining process, contract <br /> administration and pursuing matters affecting wages, hours . <br /> and conditions of employment, ("fair share deduction") , but <br /> such amount shall not exceed the amount of dues uniformly <br /> required of members and deducted pursuant to said Section 1 <br /> of this Article. Such amount deducted as provided herein <br /> shall be delivered to Council 31 on or before the 15th day of <br /> the month next succeeding the month in which said amount was <br /> deducted and provided that said amount may be paid to a non- <br /> religious charitable organization mutually agreed upon by the <br /> employee and the Union, as provided by law. <br /> Section 3 . Indemnification. <br /> The Union shall indemnify, defend and hold the Library <br /> and City harmless against any claim, demand, suit or <br /> liability arising from any action taken by the Library or <br /> City in complying with this Article. <br /> ARTICLE VI <br /> GRIEVANCE PROCEDURE <br /> Section 1 . Definition <br /> A grievance shall mean a written complaint by the <br /> Union or a member of the bargaining unit that there has been <br /> an alleged violation, misinterpretation, or misapplication <br /> of the provisions of this Agreement. <br /> Section 2 . Time Limitation <br /> Grievances must be filed within ten (10) working days of <br /> the occurrence of the event or within ten (10) working days of <br /> when the grievant should have been aware of the violation. <br />
