Marley, P.E., Public Works Director <br /> SUBJECT: Agreements with Archer Daniels Midland Corporation for the Construction <br /> of an Overhead Structure at Faries Parkway <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council approve the attached resolution authorizing an <br /> agreement with Archer Daniels Midland Corporation(ADM) to construct and maintain an <br /> overhead structure across Faries Parkway, west of Brush College Road and that the Mayor be <br /> authorized to sign and the City Clerk to attest. <br /> PRIOR COUNCIL ACTION: <br /> There has been no prior Council action on this item. <br /> BACKGROUND: <br /> In 2010 and 2011, Archer Daniels Midland Corporation(ADM) constructed a rail yard in the <br /> area west of Brush College Road and north of Faries Parkway. The project also included a <br /> Railroad Operations building. ADM wishes to construct a facility to connect said rail yard to the <br /> ADM West Plant. The West Plant is located at the southwest corner of Faries Parkway and <br /> Brush College Road. In order to connect the two operations, a conveyor system is required that <br /> will aerially cross Faries Parkway. The proposed conveyor system will be located approximately <br /> 800' west of Brush College Road and will not conflict with any intersection improvements that <br /> are currently under study at the intersection of Faries Parkway and Brush College Road. <br /> Chapter 41.1 of Decatur's City Code contains the standards for construction of facilities in the <br /> public right-of-way; however the Chapter is primarily intended for utility facilities. The <br /> resolution allows the City to enter into an agreement with ADM that sets forth the rights and <br /> responsibilities of the construction, maintenance and decommissioning of an overhead conveyor <br /> system. The agreement was based on Chapter 41.1 of the City Code and includes requirements <br /> for the decommissioning of the structure if it should cease to operate. Additionally, engineered <br /> drawings will be subject to review by the City's Fire, Engineering, Planning and Building <br /> Inspection Divisions. <br /> Page 11 <br />
