Notice of Agency Purpose of This Document This document is not a contract but rather constitutes notification by a Customer to Illinois Power Company of its appointment of an agent and acknowledgement by Customer of notice of Illinois Power's rules and policies applying to Customers using Agents. This Notice does NOT govern the relationship between the Customer and the Agent. Account Agent Information The undersigned customer("Customer")hereby notifies Illinois Power Company("Utility")that it has appointed MidAmerican Energy Company as agent("Account Agent")for dealing with Utility in regard to Account # SEE ATTACHED ("Account"). Account Agent may be contacted at the following address,telephone/fax numbers,and Web site(attach sheet if more room is needed): 4299 NW Urbandale Dr.,Urbandale IA 50322 Phone: 800-432-8574 Fax: (515)242-4354 www.midamerican.com Customer Responsibilities If the Account Agent will be receiving or paying bills from Utility on Customer's behalf(`Billing Agent"),Customer shall remain ultimately responsible to pay Utility balances due for services rendered by Utility,even if Account Agent fails to remit to Utility amounts paid by Customer to Account Agent.Customer shall be responsible to protect its interests with the Account Agent, Customer Communication If the Account Agent will be acting as a Billing Agent for Customer or otherwise designated to receive communications from Utility on Customer's behalf,Customer acknowledges that Utility will deal with the Account Agent as to all matters affecting the Account except that the Utility reserves the right to communicate directly with Customer,on matters including,but not limited to,tree trimming,planned outages,disconnection,and Customer's credit. If the Customer has not explicitly designated responsibility for account communications to be routed through the Agent,Then the Utility will communicate directly with Customer on all matters affecting the account. Customer acknowledges that Utility will release Customer's billing details to the Agent. Scope of Utility Responsibi% Utility may rely on this notice until Customer provides Utility with a written notice of termination of the appointment. Utility shall not be held responsible for any failure of the Account Agent to represent Customer's interest adequately. Customer acknowledges Utility will not perform services for Account Agent that it does not perform for Customer. If Customer has notified Utility of the appointment of multiple Account Agents,Utility will deal with any one of the Account Agents as authorized to speak for Customer as to all matters affecting Customer's service with respect to the designated account.
